Restaurant & Catering Industry Association Membership Terms and Conditions These terms and conditions set out the terms and conditions upon which Restaurant & Catering Industry Association agrees to provide to members services of a commercial nature. 1. Definitions: 1.1 Member – means any member of the Association but shall not include an Associate Member, an affiliate member or subscriber or honorary member. 1.2 Associate Member – Natural person, firms, partnerships and corporations engaged in the manufacture, production, distribution or provision of goods and services relating to the Food service industry. Associate Members will not be entitled to vote at any General Meeting of the Association or and shall be not eligible of election to the Management Committee. 1.3 You – means Member and/or Associate Member. 2. Duration of Membership or Subscription 2.1 Membership of Restaurant & Catering Industry Association is for an initial period of 12 months with subsequent annual subscription renewal. Termination can only be effected in accordance with clause 7.1. 3. Member Benefits 3.1 Restaurant & Catering Industry Association provides its members with a range of services and benefits as part of its membership. The provision of such services and benefits is at all times at the absolute discretion of Restaurant & Catering Industry Association and is subject to change, variation or cancellation at any time. Details of Restaurant & Catering Industry Association’s membership packages and the services and benefits offered by Restaurant & Catering Industry Association are provided on our website at restaurantcater.asn.au and are subject to change. Restaurant & Catering Industry Association makes no representation or promise that the services offered at the time of joining or renewal of membership will continue to be provided to members. 4. Associate Members 4.1 Associate Members are not entitled to the full range of services available to members. Associate members are entitled to some services on a fee for service basis including some workplace relations services. 5. Fair use of information and advice 5.1 You agree that any information or advice provided to you by Restaurant & Catering Industry Association is provided for the use of the member only. You agree not to use the information or advice for commercial resale or gain. You agree not to provide such information or advice to any third party for the use or benefit of the third party. 5.2 You agree not to use your access to Restaurant & Catering Industry Association information and advice to obtain information or advice for the use of a third party (including any subsidiaries or related companies that are not members if Restaurant & Catering Industry Association). 5.3 In the event that information or advice provided to you by Restaurant & Catering Industry Association is provided to any third party Restaurant & Catering Industry Association reserves the right to suspend or cancel the provision of further services to you until such time as it is satisfied that you have ceased to do so. No refund of any membership fee paid will be due. Any unpaid membership fee will remain due and payable as a debt due to Restaurant & Catering Industry Association. 5.4 Except as otherwise described in these terms and conditions, Restaurant & Catering Industry Association will send periodical communications and promotions from sponsors and/or Associate members, if You do not wish to receive these please tick the box 6. Disclaimers 6.1 Restaurant & Catering Industry Association is not liable for any loss or damage caused to a member due to the non-provision of services to the member as a result of the suspension or cancellation of such services to the member or as a result of Restaurant & Catering Industry Association changing the services it provides or no longer offering services in the exercise of its discretion. 6.2 Information provided by Restaurant & Catering Industry Association and its employees, officers and agents is of a general nature only and is not legal, accounting or other professional advice. While all reasonable endeavours are made to ensure the accuracy of information provided, Restaurant & Catering Industry Association accepts no liability for any action, or decision not to act, taken by you on the basis of the information provided to you, or for any error in or omission in the information provided by Restaurant & Catering Industry Association, or any loss or damage caused to you or any other person whether a member of Restaurant & Catering Industry Association or not, as a result of information provided by Restaurant & Catering Industry Association being inaccurate. Without limiting the generality of this disclaimer, no responsibility or liability is accepted by Restaurant & Catering Industry Association for any losses incurred in contract, tort, negligence, or any other cause of action, or for any consequential or other forms of loss. 6.3 Any liability, including for consequential losses, in respect of any claim arising out of or in connection with the relationship established by your membership of Restaurant & Catering Industry Association shall not in any event (and whether or not such liability results from or involves negligence) exceed the amount of membership fees last paid by you. 7. Renewal Fees 7.1 Membership to the Restaurant & Catering Industry Association is for an annual term of twelve (12) months (or “initial term”). Fees can be paid annually or monthly, these fees are automatically billed at the end of each month until cancelled. Annual fees are automatically renewed after 12 months on the same terms and conditions of this Agreement, unless members notify the Restaurant & Catering Industry Association of their desire to cancel their subscription four (4) weeks prior to the twelve (12) month renewal date. The Restaurant & Catering Industry Association will use best endeavours to notify members of their annual fees two (2) weeks before for renewal date, reminding them of their ability to cancel their subscription before automatic renewal. 7.2 For monthly membership payments if there is no response prior to the renewal date, your fees will be automatically renewed on the 28th day of your renewal month. It is your responsibility to notify Restaurant & Catering Industry Association of your intention to cancel your membership before the renewal date should you wish to do so. 7.3 If there are insufficient funds, your subscription will be automatically terminated, and an invoice will be sent for the balance of your annual membership.
